Contest Terms and ConditionsCLOVER WIN A FREE WEBSITE CONTEST OFFICIAL RULES
1. Eligibility: The Clover Win A Free Website Contest (the “Contest”) is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years old at the time of entry, and represent non-profit religious organizations. Employees of Worship Leader Partnership and its parent and affiliate companies, Clover Sites, Inc. (collectively the Administrators) as well as those who are contest sponsors as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. The Contest is subject to all applicable federal, state, and local laws and regulations. Void where prohibited. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and any of Sponsor’s and Administrator’s determinations with respect thereto, which are final and binding in all matters related to the Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein.

3. Timing: The Contest begins on July 1, 2009 at 12:00 a.m. Pacific Standard Time ("PST"). Submission ends Aug 31, 2009 (the Submission period). Contest ends Sept 5, 2009 (the Contest period) when the winner will be announced. Administrator computer is the official time-keeping device for the Contest.
4. How to Enter: During the Submission Period, visit: http://www.worshipleader.com/clover_contest and complete a Contest registration form, including your answer to why you think your ministry is most deserving of winning the contest (the ‘Submission’) and your agreement to these Official Rules.
By making a Submission, the Participant represents and warrants to Worship Leader magazine that (i) the Participant is the sole and exclusive owner of the Submission, or the Participant has all rights and authority to grant the rights in the Submission to the Administrators; (ii) the Participant releases in the rights of privacy and rights of publicity; to the Administrators.
5. Determination of Winners: The executive staff of Clover Sites, Inc. (“Judges”) will determine of the finalists in the contest, their decisions as to the administration and operation of the Contest and the selection of the potential winners are final and binding in all matters related to the Contest. The Judges will select three potential winners based on the creativity and merit of the submission and entry form. These will be ranked first, second and third. If the first potential winner, when contacted, is determined to be ineligible, fails to sign and return to Clover Sites, Inc., within ten (10) days of the date notice or attempted notice is sent, an Affidavit of Eligibility and Liability & Publicity Release in order to claim his/her Prize, or is otherwise disqualified the second potential winner will be contacted. Potential winners must continue to comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements. In the event that a potential winner is disqualified for any reason, the second potential winner will be deemed the winner of the applicable prize. Up to two (2) alternate potential winners will be selected in this manner, after which the applicable prize will go un-awarded. Prizes will be fulfilled with two (2) weeks after winners are confirmed.
6. Prizes: One (1) Grand Prize: Grand Prize Package includes: One free Clover website ($1000) plus one free year of hosting ($240) Total value = $1240. For details of what Clover websites include, please visit www.cloversites.com. Approximate Retail Value (ARV) $1,240.
7. Abuse: By entering the Contest, Participant expressly agrees that the Submissions do not contain content that is unlawful, libelous, slanderous, defamatory or invasive of another person's right of privacy or right of publicity, or that the Administrators may reasonably deem harmful, vulgar, obscene, derogatory, pornographic, abusive, harassing, threatening, hateful, objectionable with respect to race, religion, creed, national origin or gender, or otherwise unfit for publication. The Administrators shall be liable in any way for the Submission. The Administrators shall have no obligation to monitor the Submission provided by the Participant to the contest, but may do so at their discretion. Any Submission that, in the sole discretion of the Administrators, is considered inappropriate or unsuitable for publication will be deemed ineligible by the Administrators, and the Administrators may, in their sole discretion, remove a Submission from the Contest. 8. Release: By receipt of any prize, winner agrees to release and hold harmless the Administrators, and all of their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Contest or receipt or use or misuse of any prize.
9. Publicity: Except where prohibited, participation in the Contest constitutes winner’s consent to the Administrators and their agents’ use of winner’s name, likeness, website, photograph, video, voice, opinions, prize and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration. Without limitation to the generality of the above provisions, the Administrators and/or any of their affiliates shall have an exclusive right to publish and use any winning Submissions in print and/or electronic form for advertising and promotion of the Administrators’ products, for exhibition, and for both commercial and non-commercial products and publications, including without limitation, using, downloading, adapting, reformatting, editing and/or resizing the winning Submissions as may be necessary and to authorize others to do any of the above without any obligation to notify or further compensate the Participant.
10. General Conditions: The Administrators reserve the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor beyond the Administrators’ reasonable control impairs the integrity or proper functioning of the Contest, as determined by the Administrators in their sole discretion. The Administrators reserve the right in their sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or any other Promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, the Administrators reserve the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
11. Limitations of Liability: The Released Parties (Worship Leader Partnership & Clover Sites, Inc.) are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) technical or human error which may occur in the administration of the Contest or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use or misuse of any prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Contest, provided that the Contest Period has not yet expired or, if it is not possible to award another entry due to discontinuance of the Contest, or any part of it, for any reason, Sponsor, in its discretion, may elect to select the winners from eligible entries received up to the date of discontinuance for any or all of the prizes offered herein.
12. Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for Orange County, California or the appropriate California State Court located in Orange County, California; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.
13. Entrant's Personal Information: Information collected from entrants is subject to the Administrators’ Privacy Policies.
